An expert witness is a professional, who has specialist knowledge in a given field, sufficient that others may officially and legally rely upon his or her expert opinion.
At Cole Easdon, our team has the education, skill and experience necessary to be expert witnesses in our chosen fields. We are equipped to provide independent, expert opinion on the consequence of developments on traffic, infrastructure and flood risk.
The independent expert evidence that we provide is used to help quickly resolve disputes between parties who are in disagreement over a particular proposal.
When called upon to be an expert witness we will:
▪ Prepare a proof of evidence.
▪ Present the evidence to a court or public
▪ inquiry.
▪ Provide a ‘statement of common ground’,
▪ which sets out the points which have
▪ already been agreed on both sides, allowing
▪ those presiding to focus only on the issues
▪ which remain to be resolved.
While acting as expert witness, we will always be objective and independent of both parties. We are happy to be instructed by either side separately, or by both sides together where we would act as a ‘single joint expert’.
The Benefits
The benefits of using an expert witness from Cole Easdon are:
▪ Helping to secure planning permission for
development if employed by a developer.
▪ Helping to secure refusal for development if
employed by a Local Authority, Residents
Group or other interested party.
▪ Providing key information in order to support
or defend legal cases for both national
insurers and Local Authorities.
▪ Reducing the time and costs of proceedings
by producing a ‘Statement of Common
Ground’.
